Court to Reconsider Decision That Permitted Trump to Deploy Military Forces to Oregon City

The ninth circuit court has upheld a prohibition on sending national guard in the Oregon city, after a recent legal decision.

Appeals Court Agrees to Reconsider Case

The federal appeals court ruled on this week that it would rehear the legal dispute concerning the president’s authority with an larger group of eleven justices. The judicial body also vacated a previous decision from a smaller judicial group that had sided with the federal government.

Legal Saga Over Military Presence

This order represents the most recent turn in a protracted legal battle over whether the former president has the legal right and justification to send state military units in the city. Approximately two hundred troops have been in limbo since the end of September when the mobilization attempt was started in response to ongoing demonstrations.

Differing Viewpoints

The federal government has claimed that federal officials at the immigration center in the southern part of the city were facing threats, while local authorities maintain that local officers have command of the situation.

Contrary to descriptions of the city as “war ravaged”, locals have been posting videos of lush hiking trails and a vibrant culinary culture, and organizing events such as an Emergency Naked Bike Ride against the “militarization of our city”.

Recent Legal Actions

The appeals court decision came after a federal judge in the city issued two legal injunctions this month – one blocking the federalization of the state troops, and another prohibiting the use of any military personnel in Oregon, after attempts to circumvent the first order by calling up troops from California.

On the previous day, the ninth circuit panel had temporarily suspended the initial decision – allowing command of state troops – but the subsequent injunction stayed effective, preventing the actual deployment of the troops.

En Banc Review

The Tuesday decision means the issue will be heard “en banc” – with all decisions under review simultaneously – by a group of 11 judges.

“This decision shows that the truth matters and that the judicial system are striving to hold this administration accountable. The founding document limits the executive authority, and local populations cannot be treated as a testing site for expansive government power,” said the state attorney general in a official comment.

“The court is sending a definite signal: the executive leader cannot send the armed forces into American urban areas without cause. We will continue protecting Oregon’s laws, values, and sovereignty as this legal proceeding progresses and our fight continues in the judicial system.”
